This Policy applies as between you, the User of this website, and Trainwell LLC, the owner and provider of this website. This Policy applies to our use of any and all Data collected by us in relation to your use of the website and any Services or Systems therein.

1. Definitions and Interpretation

  • In this Policy the following terms shall have the following meanings:
  • "Account" means collectively the personal information, payment information, and credentials used by Users to access the Services.
  • "Content" means any text, graphics, images, audio, video, software, data compilations, and any other form of information capable of being stored in a computer that appears on or forms part of this website.
  • "Cookie" means a small text file placed on your computer by Trainwell LLC when you visit certain parts of this website.
  • "Data" means collectively all information that you submit to the website, including but not limited to Account details and information submitted using any of our Services or Systems.
  • "Trainwell LLC" means Trainwell LLC, an Iowa limited liability company, with a mailing address at 1800 Green Oak Pass, Tiffin, IA.
  • "Service" means collectively any online facilities, tools, services, or information that Trainwell LLC makes available through the website either now or in the future.
  • "System" means any online communications infrastructure that Trainwell LLC makes available through the website either now or in the future.
  • "User" or "Users" means any third party that accesses the website and is not employed by Trainwell LLC acting in the course of their employment.
  • "Website" means the website that you are currently using (trainwell.co) and any sub-domains of this site unless expressly excluded by their own terms and conditions.

2. Data Collected

  • Without limitation, any of the following Data may be collected:
  • • Name and job title.
  • • Agency name and business role.
  • • Contact information such as email address and telephone number.
  • • Financial information necessary to complete payment (handled by Stripe — we do not store card numbers on our own systems).
  • • Learning-activity data such as courses viewed, quizzes taken, live-session attendance, and progress within the platform.
  • • IP address, web browser type and version, operating system, and referring URLs (all automatically collected via standard server logs).
  • • Cookie information (see Clause 10 below).

3. Our Use of Data

  • 3.1 Any personal Data you submit will be retained by Trainwell LLC for as long as you use the Services provided on the website, and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce agreements.
  • 3.2 Unless we are obliged or permitted by law to do so, and subject to Clause 4, your Data will not be disclosed to third parties. This includes our affiliates and other companies within our group.
  • 3.3 All personal Data is stored securely. For more details on security, see Clause 9 below.
  • 3.4 Any or all of the above Data may be used by us for the following reasons:
  • 3.4.1 Internal record keeping;
  • 3.4.2 Delivering, personalizing, and improving the training platform;
  • 3.4.3 Providing coaching, support, and account management;
  • 3.4.4 Sending transactional emails (course notices, session reminders, receipts) and, where you have not opted out, occasional product updates you can unsubscribe from at any time;
  • 3.4.5 Detecting fraud, abuse, and security incidents.

4. Third-Party Websites and Services

Trainwell LLC employs the services of other parties to operate the platform. These include Stripe (payment processing), Supabase (authentication and database), LearnWorlds (course delivery for certain content), Zoom (live coaching calls and recordings), GoHighLevel (CRM and lifecycle communications), Google Cloud (API hosting and logging), and Vercel (website hosting). Any Data used by such parties is used only to the extent required to perform the services that Trainwell LLC requests; any use for other purposes is strictly prohibited. Data processed by third parties must be processed in accordance with the terms of this Policy and applicable law.

5. Changes of Business Ownership and Control

  • 5.1 Trainwell LLC may, from time to time, expand or reduce its business, and this may involve the sale or transfer of certain divisions to other parties. Data provided by Users will, where relevant, be transferred along with that division, and the new owner will, under the terms of this Policy, be permitted to use the Data for the purposes for which it was originally supplied.
  • 5.2 In the event that any Data submitted by Users will be transferred in such a manner, you will be contacted in advance and informed of the changes. When contacted, you will be given the choice to have your Data deleted or withheld from the new owner or controller.

6. Controlling Access to Your Data

  • 6.1 Wherever you are required to submit Data, you will be given options to restrict our use of that Data. This may include the following:
  • 6.1.1 Use of Data for direct marketing purposes; and
  • 6.1.2 Sharing Data with third parties beyond what is necessary to deliver the Services.

7. Your Right to Withhold Information

  • 7.1 You may access certain areas of the website without providing any Data at all. However, to use all Services available on the website, you may be required to submit Account information or other Data.
  • 7.2 You may restrict your internet browser's use of Cookies. For more information see Clause 10 below.

8. Accessing Your Own Data

  • 8.1 You may access your Account at any time to view or amend your Data. You may need to modify or update your Data if your circumstances change.
  • 8.2 You have the right to request a copy of your personal Data at no charge, and to request its deletion. To do either, email support@trainwell.co.

9. Security

Data security is of great importance to Trainwell LLC. To protect your Data we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure Data collected online. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

10. Cookies

The website uses cookies to keep you signed in, remember your preferences, and understand how the site is used. Session cookies are required to operate the platform (you cannot sign in without them). You may restrict cookie use through your browser settings; note that doing so may limit functionality.

11. Your California Privacy Rights (CCPA / CPRA)

  • If you are a California resident, you have specific rights regarding your personal information under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"):

  • • The right to opt out of the "sale" or "sharing" of personal information.
  • • The right to limit the use and disclosure of sensitive personal information.
  • • The right to non-discrimination for exercising any of these rights.
  • Do Not Sell or Share My Personal Information. Trainwell LLC does not sell your personal information and does not share it for cross-context behavioral advertising, as those terms are defined under the CCPA/CPRA. Because we do not engage in either practice, no additional opt-out is required — but if you want written confirmation of your record, email support@trainwell.co and we'll send it.
  • To exercise any of these rights, email support@trainwell.co. We will respond within the timeframes required by law (typically 45 days).
  • Global Privacy Control ("GPC"). We honor GPC signals sent from your browser as a valid opt-out request where applicable.

12. Children

The Services are intended for adults acting in a professional capacity. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact support@trainwell.co and we will delete it.

13. Changes to This Policy

Trainwell LLC reserves the right to change this Privacy Policy as we may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the website, and the "Last updated" date at the top will reflect the change. Where changes are material, we will notify affected users by email.
